These Terms of Service ("Terms") govern your access to and use of the website located at darehomes.com.au, together with any related applications, buyer or member portals, downloads, competitions, forms and other digital services we make available (collectively, the "Services").

The Services are operated by DARE Homes Pty Ltd (ACN [insert], ABN [insert]) ("DARE Homes", "we", "us" or "our").

By accessing or using the Services you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. About the Services

The Services provide information about DARE Homes, our home designs, house and land packages, display homes, communities, events and related offerings. They also include tools for enquiring about our products, subscribing to updates, accessing member or buyer areas, and using any other digital features we make available from time to time.

We may add, change, suspend or remove features of the Services at any time without notice.

2. Eligibility

You must be at least 18 years of age and legally able to enter into a binding contract to use the Services. By using the Services you confirm that you meet these requirements.

3. Your account

Some parts of the Services require you to register or log in. If you create an account you agree to:

• provide accurate, current and complete information;

• keep your login credentials secure and confidential;

• notify us promptly of any unauthorised use of your account; and

• accept responsibility for all activity that occurs under your account.

We may suspend or terminate your account at any time if we reasonably believe you have breached these Terms.

4. Marketing content, renders, plans and pricing

Images, renders, artist impressions, floorplans, inclusions, specifications, dimensions, finishes, landscaping, streetscapes, facades, display homes, virtual tours, videos and pricing shown on the Services are for illustrative and marketing purposes only.

You acknowledge and agree that:

• renders and artist impressions are conceptual and may include items, finishes, upgrades, landscaping, furniture, décor, fixtures or features that are not standard inclusions and are not supplied by DARE Homes;

• floorplans, dimensions and site layouts are indicative, are not to scale, and may change during design, engineering, siting, council approval or construction;

• displayed inclusions and specifications may vary between designs, packages, regions, estates and stages, and are subject to availability;

• pricing, promotions, incentives and package configurations are indicative only, are subject to change without notice, may be subject to eligibility criteria and site conditions, and do not constitute an offer capable of acceptance;

• house and land package pricing is subject to land availability, developer terms, siting, engineering, contour, covenants, site costs and final contract documentation;

• display homes may include upgrades, promotional items and non-standard features that are not included in the base price of any design; and

• no information on the Services forms part of any contract for the design, sale or construction of a home unless it is expressly incorporated into a signed written contract with DARE Homes.

Where a discrepancy exists between the Services and a signed contract, the signed contract prevails.

5. Enquiries, lead handling and marketing contact

When you submit an enquiry, register interest, request a callback, download a brochure, subscribe to updates, enter a competition, or otherwise provide your contact details through the Services, you consent to DARE Homes and its related entities, sales agents, project partners and authorised representatives contacting you in relation to your enquiry and our products and services, including by telephone call, SMS, MMS, messaging apps, email and post.

You acknowledge and agree that:

• contact may be made using the details you provide, including outside standard business hours where reasonable;

• your enquiry may be shared with the relevant sales consultant, display home team, project partner, land developer or referral partner for the purpose of responding to you;

• we may send you marketing communications about designs, packages, events, promotions and related offerings, and you can opt out of marketing at any time using the unsubscribe link in our emails or by contacting us;

• transactional communications relating to your enquiry, account, contract or purchase will continue even if you opt out of marketing; and

• we may record inbound and outbound calls for quality, training, coaching and compliance purposes, subject to applicable law.

Our handling of your personal information is governed by our Privacy Policy, available on the Services.

6. Acceptable use

You agree not to:

• use the Services in a way that breaches any law, regulation or third-party right;

• interfere with, disrupt, overload or damage the Services or any network, server or infrastructure connected to them;

• attempt to gain unauthorised access to any part of the Services, other accounts, or related systems;

• introduce viruses, malware or other harmful code;

• reverse engineer, decompile or attempt to extract source code from the Services, except to the extent permitted by law;

• use any automated system, bot, scraper or data-harvesting tool to access or collect content from the Services without our prior written consent;

• resell, sublicense, redistribute or commercially exploit the Services or their content; or

• misrepresent your identity or affiliation with any person or organisation.

7. Intellectual property

All content on the Services, including text, copy, brand elements, logos, trade marks, images, renders, plans, videos, software, code, layout, design and the DARE® name and marks, is owned by DARE Homes or its licensors and is protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal, non-commercial use in connection with a genuine interest in our products and services. All other rights are reserved.

You must not copy, reproduce, adapt, modify, publish, distribute, frame, mirror or create derivative works from any part of the Services without our prior written consent, except as permitted by law.

8. Third-party content and links

The Services may contain links to third-party websites, tools, services and content, including maps, developer information, finance calculators, social media and analytics providers. We do not control, endorse or accept responsibility for any third-party content or services, and your use of them is at your own risk and subject to the relevant third party's terms.

9. Availability

We aim to keep the Services available, but we do not guarantee that access will be uninterrupted, timely, secure or error-free. We may suspend, restrict or discontinue all or part of the Services at any time for maintenance, upgrades, security or operational reasons.

10. Disclaimers

To the maximum extent permitted by law, the Services and all content on them are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.

We do not warrant that:

• the Services will meet your requirements;

• content, pricing, availability or specifications shown on the Services are accurate, current or complete; or

• the Services will be free from errors, defects, viruses or harmful components.

Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies under the Australian Consumer Law or any other law that cannot lawfully be excluded.

11. Liability

To the maximum extent permitted by law, DARE Homes, its related entities, directors, officers, employees, agents and contractors are not liable to you for any indirect, incidental, special, consequential or punitive loss or damage, or for any loss of profit, revenue, business, opportunity, data or goodwill, arising out of or in connection with your use of the Services.

Where our liability cannot be excluded but can be limited, our total liability to you for all claims arising out of or in connection with the Services is limited, at our option, to resupplying the relevant part of the Services or paying the cost of having it resupplied.

12. Indemnity

You agree to indemnify and hold DARE Homes harmless from and against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal costs) arising out of or in connection with your breach of these Terms, your misuse of the Services, or your infringement of any law or third-party right.

13. Privacy

Your privacy is important to us. Our collection, use, disclosure and storage of personal information is described in our Privacy Policy, available on the Services. By using the Services you acknowledge that you have read our Privacy Policy.

14. Changes to these Terms

We may update these Terms from time to time. The current version will always be available on the Services and will show the "Last updated" date. Your continued use of the Services after any change constitutes acceptance of the updated Terms.

15. Termination

We may suspend or terminate your access to the Services at any time, without notice, if we reasonably believe you have breached these Terms or if we discontinue any part of the Services. Provisions that by their nature should survive termination, including intellectual property, disclaimers, liability, indemnity and governing law, will continue to apply.

16. Governing law and jurisdiction

These Terms are governed by the laws of Queensland, Australia. You and DARE Homes submit to the exclusive jurisdiction of the courts of Queensland and the courts competent to hear appeals from them.

17. General

If any part of these Terms is found to be unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign or transfer your rights under these Terms without our prior written consent. These Terms, together with our Privacy Policy and any other terms we notify you of, form the entire agreement between you and DARE Homes in relation to the Services.
